Liability Disclaimer & Customer Responsibility Agreement

By purchasing ammunition or related products from Sphere Research & Development (“Sphere R&D,” “we,” “us,” or “our”), you (“the customer”) affirm that you understand and accept all inherent risks associated with the possession and use of ammunition, and you assume full legal responsibility for your actions related to our products. The following terms govern the limitations of our liability and outline your obligations as the purchaser.

 
Use at Your Own Risk
Ammunition and firearms are inherently dangerous products. Improper storage, handling, or usage of ammunition can result in serious bodily injury, death, property damage, or criminal liability. By purchasing from Sphere R&D, you accept all risks and responsibilities associated with owning and using ammunition. You agree that:

You are purchasing for lawful personal use only, not resale or unlawful distribution.
You are responsible for determining whether you may legally possess and use ammunition under applicable federal, state, and local laws.
You understand that all products should be used only by those who are properly trained in firearms safety and in compliance with all laws.
You agree to follow all manufacturer safety instructions, use common sense, and act responsibly at all times when handling firearms and ammunition.
 
No Warranty or Guarantee
Sphere R&D provides all products “as is” and “as available” with no warranty—express or implied—including, but not limited to:

No guarantee of compatibility with any specific firearm make or model
No warranty of merchantability or fitness for a particular purpose
No representation or guarantee of performance, accuracy, or reliability under any specific use conditions
You acknowledge that ammunition performance can vary based on firearm condition, environmental conditions, barrel wear, and many other factors outside our control. The customer assumes full responsibility for testing and verifying compatibility before use.

 
Customer Responsibility
By making a purchase from Sphere R&D, the customer agrees to:

Follow all firearm safety protocols, including those from the NRA, manufacturers, and local safety organizations
Ensure that any firearm used is in safe working condition, regularly maintained, and operated by someone competent in firearm usage
Inspect all ammunition before use for signs of damage, corrosion, or contamination
Use ammunition only in firearms of the proper caliber, marked accordingly on both the firearm and the ammunition packaging
Comply with all federal, state, and local laws regarding the purchase, transportation, use, and storage of ammunition
Store ammunition in a cool, dry, secure environment away from ignition sources, children, and unauthorized persons
Never attempt to modify, disassemble, or reload factory ammunition
You further acknowledge that it is your duty to research and comply with laws applicable in your area regarding ammunition possession, use, and storage. Sphere R&D will not be held responsible for any legal consequences that result from unlawful use or possession.

 
Third-Party Misuse
Sphere R&D is not responsible for any injury, damage, or death resulting from the misuse of ammunition by third parties, including but not limited to:

Guests in your home
Family members, children, or dependents
Employees, students, or subordinates
Unauthorized users due to theft, loss, or negligence
It is your responsibility to secure and control all ammunition and to prevent its access by unauthorized individuals.

 
Indemnification
By purchasing from Sphere R&D, you agree to indemnify, defend, and hold harmless Sphere Research & Development, including its owners, officers, employees, contractors, affiliates, suppliers, and agents from and against any and all claims, demands, losses, costs, liabilities, lawsuits, damages, or legal proceedings—whether direct or indirect—that arise from:

Use or misuse of any product purchased from us
Violation of firearm or ammunition laws
Failure to adhere to safety protocols or proper storage procedures
Third-party injury or property damage resulting from your purchase, possession, or use of our products
Any act of negligence or recklessness on your part or the part of someone to whom you granted access
This indemnification obligation survives the termination of your use of our products and/or this website.

 
Limitation of Liability
To the fullest extent permitted by law, Sphere R&D shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising out of or connected in any way to your use of, or inability to use, any of our products. This includes, but is not limited to:

Personal injury or death
Property damage
Lost profits or data
Regulatory or legal penalties
Incompatibility or mechanical failure
Even if Sphere R&D has been advised of the possibility of such damages, our total liability to you for any claim shall not exceed the amount you paid to us for the product in question.

 
Legal Jurisdiction
This page is governed by the laws of the State of [Insert State], and any legal disputes shall be resolved in the state or federal courts located in [Insert County/State]. By purchasing from Sphere R&D, you consent to the jurisdiction of those courts.

 
Acknowledgment of Understanding
By purchasing products from Sphere R&D, you acknowledge that you have read, understood, and agreed to this Liability Disclaimer & Customer Responsibility Agreement in its entirety. You further confirm that:

You are legally authorized to purchase and possess ammunition
You accept full responsibility for the risks associated with such ownership and use
You release Sphere R&D from all liability as detailed above
